GENERAL TERMS AND CONDITIONS
1. Inclusion of the GTC
The following terms and conditions apply to all contracts concluded in connection with the CA Tennis School represented by Caroline Ancicka and Alia Lex (hereinafter referred to as the Tennis School). Subsidiary agreements, amendments or additions must be made in writing.
2. Conclusion and duration of the contract
The submission of your registration constitutes an offer to the Tennis School to conclude a service contract. The tennis school is free to accept the offer. Upon conclusion of the contract, the General Terms and Conditions are recognised. The contract is valid for the training period advertised and cannot be cancelled prematurely. In the event of premature cancellation, the full invoice amount must be paid. No refunds will be made for contracts already paid. The general terms and conditions of the tennis school, the court and hall regulations of TC Rot-Blau Regensburg e.V. are binding for all training participants.
3. Training
Our range of services includes team, group and individual training as well as video analyses via email. The coaches at the tennis school organise the groups according to practical requirements, in particular playing ability and age. The grouping can be changed if necessary. The tennis school reserves the right to organise the coaches. If this is necessary for organisational reasons, the tennis school is also permitted to change coaches or give substitute lessons during the season. We will take the wishes of our customers into consideration as far as possible. If courses are not fully booked, there may be changes to the group that require a new agreement. Such a change does not constitute grounds for cancellation. The tennis school is permitted to add other course participants to a group for a "taster". This requires prior agreement with the group participants. The resulting change in the cost of lessons will be reimbursed to the original group participants by the new student.
4. Training programme
A training session lasts 60, 90 or 120 minutes. During this time, the required court maintenance and warm-up also take place. Training sessions may only be started in sportswear and tennis shoes. The tennis courts in the tennis halls may only be entered with suitable footwear, i.e. footwear that is appropriate for the hall surface. Possible illnesses or other health restrictions must be expressly communicated to the trainer of the tennis school before the start of the training session. Sweets of any kind are prohibited during training. Glasses and unsealable bottles are not permitted on the indoor court. The coach's instructions must be followed at all times.
5a. Training costs
The training costs are to be paid by transfer of the invoice sent to you. The agreed total prices are always valid. This total price includes the VAT applicable at the time of the agreement and the training material.
5b. Hall costs
For the use of the hall in connection with the tennis training of the tennis school, hall utilisation fees will be charged separately by the tennis school.
6. Cancelled lessons
Lessons missed during team or group training cannot be made up for organisational reasons. In accordance with § 615 BGB, our obligation to perform is cancelled. The claim to the training fee remains valid. If agreed individual training appointments cannot be kept by the customer of the tennis school, the customer must inform the tennis school immediately, but no later than 24 hours before the appointment. The coaches will then reschedule the cancelled training session at another time. Appointments cancelled by the customer more than 1 time 24 hours in advance or at shorter notice will not be rescheduled. The tennis school's obligation to perform and its entitlement to the training fee remain unaffected. Training sessions that had to be cancelled by the coach will be taken over by a substitute coach if possible or a make-up date will be agreed. The tennis school will name several make-up dates. If the customer is unable to attend the make-up dates, the tennis school's obligation to perform shall lapse and no reimbursement of the training costs shall be due. If no make-up dates are offered by the tennis school, the costs will be refunded or not invoiced for the new season.
In the event of rain or other events (association matches, tournaments, etc.), lessons will be moved indoors during the summer season for an additional charge. If no indoor space is available and the training session has not yet started, the training session will be rescheduled.
7. Supervision of minors
The tennis school coaches' duty to supervise underage children is limited to the duration of the training session. The coaches of the tennis school assume no liability outside of the training session. The legal guardians must ensure that their child(ren) are supervised before and after the training sessions. Parents/guardians must inform their child(ren) that they are not allowed to leave the training area and must follow the instructions of the coach. The coaches of the tennis school accept no liability if a child leaves the training area.
8. Supervision
The tennis school's liability for any damage you incur in connection with the training programme of any kind is limited to cases of intent or gross negligence.
9. General rules of validity
Should individual provisions of the terms and conditions of business and play be legally invalid or cannot be applied, this shall not affect the validity of the remaining provisions. Instead, the provisions that most closely fulfil the intended legal and economic purpose shall apply.
10. Data protection and use of image material
Your personal data will be stored electronically by us. Your data will not be passed on to third parties. We are authorised to store your data for a period of three years after the end of training. The tennis school is authorised to use pictures, titles, media articles, successes, names etc. of the player without further permission or consideration.
